1. Acceptance of these terms

This website is operated by Fortune Kid Inc. (“Fortune Kid,” “we,” “us,” “our”), a corporation organized under the laws of the State of New Jersey, USA. By accessing or using this website, you agree to these Terms of Use. If you do not agree with them, please do not use the website.

These terms are an agreement between you and Fortune Kid. Please read them together with our Privacy Policy, keeping in mind the difference in scope described in the next section.

2. What these terms cover

These terms apply only to this website and its pages. They do not govern anything else we make or distribute. In particular:

This website is informational. It has no user accounts, no sign-in, no forms, no comments, no uploads, and no checkout. Nothing here is sold, and nothing here can be purchased.

3. Who may use this website

You may use this website if you are at least 13 years old. This website is not directed to children under 13. Because it offers no accounts and accepts no submissions, there is nothing here for a child to sign up for or send us.

You are responsible for complying with the laws that apply to you where you are. We make no representation that the content on this website is appropriate or available in every jurisdiction.

4. Permission to use this website

We grant you a personal, non-exclusive, non-transferable, revocable permission to access and view this website for your own information, and to print or save individual pages for your own non-commercial reference. Section 6 grants additional permissions to press and to people evaluating our business.

This permission is not a transfer of ownership. All rights we do not expressly grant are reserved.

5. Our intellectual property

Everything on this website — the text, layout, source code, stylesheets, artwork, screenshots, video, 3D scenes, characters, sound, and design — is owned by Fortune Kid or used by us with permission, and is protected by copyright, trademark, and other laws.

Fortune Kid, FortuneKid, Hua, UNI, our logo, and the names, characters, and visual identity of our games and products are trademarks of Fortune Kid Inc., whether or not registered. Other names and logos that appear on this website belong to their respective owners and are used only to identify those parties.

Except as permitted in Sections 4 and 6, you may not copy, reproduce, republish, adapt, translate, distribute, publicly display, or create derivative works from any part of this website without our prior written permission.

6. Press and media use

We welcome coverage. If you are a journalist, reviewer, creator, analyst, or investor, you may use our logo, product names, screenshots, and video from this website to report on, review, or evaluate Fortune Kid and its products, without asking us first, provided that:

• You reproduce the materials as published, without altering, recoloring, cropping in a misleading way, or combining them with other marks
• You attribute them to Fortune Kid Inc.
• You do not imply that we sponsor, endorse, or are affiliated with you or your publication
• You do not use them on merchandise, or as part of your own product, service, logo, domain name, or app name

For anything outside these limits — higher-resolution assets, interviews, or other uses — write to us at the address in Section 19 and we will usually say yes.

7. Things you may not do

When using this website, you agree not to:

• Scrape, crawl, harvest, or use any robot, spider, or automated means to collect content from this website, other than an ordinary search-engine crawler obeying our robots directives
• Use any content from this website to train, fine-tune, or otherwise develop a machine learning or artificial intelligence model, or to build a dataset for that purpose. We expressly reserve all rights in this website against text and data mining, including for the purposes of Article 4(3) of EU Directive 2019/790
• Attempt to gain unauthorized access to this website, its hosting infrastructure, or any connected system; probe or scan for vulnerabilities; or interfere with its normal operation
• Introduce malware or any other harmful code
• Reverse engineer, decompile, or disassemble any part of this website, except to the extent that restriction is prohibited by applicable law
• Frame or mirror this website, or present it in a way that obscures its origin or suggests it is yours
• Remove, obscure, or alter any copyright, trademark, or other proprietary notice
• Misrepresent your affiliation with Fortune Kid, or impersonate us or anyone associated with us
• Use this website for any unlawful purpose, or in any way that could damage, disable, or impair it

8. Ideas, feedback, and unsolicited submissions

We are always glad to hear from players and from people who love games. But we have to be direct about one thing, because it protects both of us.

Please do not send us confidential or proprietary ideas. We work on many projects at once, and our own teams independently develop concepts that may resemble ideas other people have had. If we received your idea in confidence, we could be prevented from continuing work we had already begun on our own.

Accordingly, if you send us any game concept, story, character, artwork, design, feature request, bug report, suggestion, comment, or other material (together, “Feedback”), by email or by any other means:

• Your Feedback is not confidential, and no confidential or fiduciary relationship is created by your sending it or by our receiving it
• We are under no obligation to review it, respond to it, keep it, return it, or refrain from using it
• You grant us a worldwide, perpetual, irrevocable, royalty-free, fully paid, sublicensable and transferable licence to use, reproduce, modify, adapt, publish, and otherwise exploit your Feedback for any purpose, without any compensation, credit, or notice to you
• You confirm that the Feedback is yours to give and that giving it does not breach anyone else’s rights
• Nothing in your Feedback limits our right to develop, acquire, or license anything similar from any source

If you would rather these terms not apply to something you want to tell us, please do not send it.

9. Forward-looking statements; no offer of securities

This website describes products that are in development and business plans that extend into the future. Statements about what we intend, expect, plan, or aim to do — including release timing, product features, roadmaps, and anything marked “upcoming,” “in development,” or “coming soon” — are forward-looking statements. They reflect our current intentions and are subject to risks, assumptions, and changes outside our control. They are not promises, guarantees, or commitments, and actual results may differ materially. We undertake no obligation to update any forward-looking statement.

Nothing on this website is an offer to sell, or a solicitation of an offer to buy, any security of Fortune Kid Inc., in any jurisdiction, nor is it investment, legal, tax, or financial advice. Any such offer would be made only through definitive offering documents delivered directly to eligible investors, and only in compliance with applicable securities laws. Nothing on this website may be relied upon in connection with any investment decision.

10. Products described on this website

Product pages on this website are descriptions of work in progress. Features, artwork, names, pricing, platforms, availability, and release dates may change, and any product described here may be delayed, substantially altered, or never released at all. Screenshots and video may show work in progress and may not represent the final product.

Availability varies by region and by platform, and is ultimately determined by the app stores and other distributors we work with, not by us alone.

11. Website privacy

Our Privacy Policy covers our games. This section covers this website, which is a plain informational site: it sets no cookies of its own, has no analytics, no advertising, no tracking pixels, and no accounts, and it asks you for nothing. Three ordinary technical details are nonetheless worth stating plainly.

• Hosting logs. This website is hosted on GitHub Pages. Like any web host, GitHub automatically receives your IP address and browser user-agent in order to deliver the pages to you, and may log that information for security and abuse prevention. This is handled by GitHub under GitHub’s Privacy Statement. We do not receive these logs and do not have a server of our own.
• Web fonts. Our pages load the Poppins typeface from Google Fonts. Your browser therefore makes a request to Google’s servers, which discloses your IP address and user-agent to Google under Google’s Privacy Policy. We receive nothing from that request and cannot identify you through it.
• Video embeds. Some pages show trailers hosted on YouTube. Nothing is requested from YouTube while you are simply reading a page: we display a still image, and the player is loaded only if you click it. Once you do, your browser connects to YouTube, which discloses your IP address and user-agent to Google under Google’s Privacy Policy. We use YouTube’s no-cookie player, so YouTube does not store cookies for advertising purposes from these embeds. We receive nothing from that request either.

Beyond this, we collect no personal information through this website. If you choose to email us, we will of course have your email address and whatever you write — we use it only to reply to you, and we do not add you to any mailing list. Note that Section 8 applies to anything you send.

12. Links to other websites

This website links to sites we do not operate, such as the Apple App Store and Google Play. We provide those links for convenience only. We do not control those sites, do not endorse them, and are not responsible for their content, products, or privacy practices. Once you leave this website, the terms and policies of the site you arrive at govern instead of these.

13. Disclaimer of warranties

This website is provided “as is” and “as available,” without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that this website will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the site or the server that makes it available is free of harmful components. We aim to keep the information here accurate and current, but we do not warrant that it is complete, accurate, or up to date, and we may change or remove any part of it at any time without notice.

Some jurisdictions do not allow the exclusion of certain warranties. In those places, the exclusions above apply only to the extent permitted.

14. Limitation of liability

To the fullest extent permitted by law, Fortune Kid Inc. and its directors, officers, shareholders, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of or inability to use this website, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.

Our total liability for all claims relating to this website will not exceed one hundred United States dollars (US$100).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, for fraudulent misrepresentation, or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations of liability; in those places, the limitations above apply only to the extent permitted.

15. Indemnification

You agree to indemnify and hold harmless Fortune Kid Inc. and its directors, officers, shareholders, employees, and contractors from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of your breach of these terms, your violation of Section 7, or your infringement of any right of another person through your use of this website.

16. Changes to these terms

We may revise these terms from time to time. When we do, we will post the revised version on this page and update the effective date at the top. Changes take effect when posted, and continuing to use this website after that means you accept the revised terms. If a change is material, we will note it on this website. These terms as revised apply going forward and do not change how a completed matter was governed at the time.

17. Governing law and venue

These terms and any dispute arising out of them or out of your use of this website are governed by the laws of the State of New Jersey and the United States, without regard to conflict-of-law principles. You and Fortune Kid agree that any such dispute will be brought exclusively in the state or federal courts located in Somerset County, New Jersey, and each of us consents to the personal jurisdiction of those courts.

If you are a consumer resident elsewhere and mandatory local law gives you the right to bring proceedings in your own courts or under your own law, this section does not take that right away from you.

18. General

If any provision of these terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign or transfer these terms; we may assign them to a successor in connection with a merger, acquisition, or sale of assets. Together with any document expressly referenced here, these terms are the entire agreement between you and Fortune Kid regarding this website, and replace any earlier version. The section headings are for convenience only. Nothing in these terms creates any partnership, agency, employment, or joint venture between us, and these terms give no rights to any third party.
